Beauvastgoed Beheer B.V. (hereinafter: Beauvastgoed) finds it important that our services are open, honest and transparent. Thus we also find it important that you are informed about the Processing of your Personal Data, which Personal Data Beauvastgoed collects, what this Personal Data is used for by Beauvastgoed, with whom your Personal Data is shared by Beauvastgoed and when your Personal Data is removed from Beauvastgoed's systems by Beauvastgoed.
Beauvastgoed is responsible for the collection and use of your Personal Data and has defined the terms under which it collects and Processes your Personal Data in this Privacy Statement. This Privacy Statement has been prepared with care. Beauvastgoed only collects and Processes your Personal Data in accordance with this Privacy Statement. Beauvastgoed ensures the collection and Processing of your Personal Data in accordance with applicable laws and regulations.
All work performed by Beauvastgoed is subject to this Privacy Statement.

1. Definitions
Words or phrases used in this Privacy Statement have the following meanings:
a. AVG: Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of Personal Data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation).
b. Beauvastgoed: controller of Personal Data.
c. Data Subject: the natural person to whom a Personal Data relates.
d. Personal Data: any information about an identified or identifiable natural person ("Data Subject") that Beauvastgoed Processes.
e. Privacy Statement: this Privacy Statement.
f. Website: the Website under www.beauvastgoed.nl.
g. Processing/Processing: an operation or set of operations involving Personal Data or a set of Personal Data, whether or not carried out by automated means, such as the collection, recording, organization, structuring, storage, updating or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, blocking, erasure or destruction of Personal Data.
2. Scope of Privacy Statement.
Unless otherwise agreed in writing, the provisions of this Privacy Statement apply to any Processing of Personal Data by Beauvastgoed.
Beauvastgoed collects and Processes Personal Data (for or on behalf of our client, or for its own account) for the purposes of:
i. the execution of agreements (rental agreements, property management agreements, contracts of assignment, employment agreements and other agreements);
ii. the processing of information requested by you regarding the services of Beauvastgoed in the broadest sense of the word (for example, through the forms on our Website); and
iii. (the improvement of) the Website as well as the services of Beauvastgoed.
Beauvastgoed Processes Personal Data only for the purposes specified in Article 2 and Article 6.
3. Collection of Personal Data.
Beauvastgoed collects Personal Data in the following manner(s):
a. when you provided this Personal Information to Beauvastgoed;
b. when you contact Beauvastgoed with a request for information about Beauvastgoed's services;
c. by being generated from the use of Beauvastgoed's services or Website, including through cookies; or
d. from third parties, such as clients under property management agreements or other agreements.
If you are required to provide certain information (for example, for the preparation of a lease), you will be informed of the possible consequences if it is not provided.
4. General obligations Beauvastgoed
Beauvastgoed must ensure compliance with the conditions imposed on the Processing of Personal Data under applicable privacy legislation such as the AVG.
Beauvastgoed provides access to Personal Data to our employees or contractors only to the extent necessary to perform our services.
5. Personal Data Processed by Beauvastgoed.
Beauvastgoed Processes your Personal Data because you use our services and/or because you have provided it to us yourself. Below you will find an overview of the Personal Data we process:

c. Date of birth
d. Place of birth
e. Address
f. Phone number
g. E-mail address
h. Marital status
i. Document number of your proof of identity
j. Income information
k. Bank and checking account number
l. Data for the purpose of maintenance and repair of the rented immovable and movable property
m. Data for the purpose of calculating and recording income and expenses, making payments and collecting receivables
n. Information obtained through cookies, such as about surfing behavior on Beauvastgoed's websites
o. Preferences for communication with Beauvastgoed
p. Other information that you actively provide and/or are relevant in the context of carrying out our services
Beauvastgoed does not process any special and/or sensitive Personal Data.
6. Purposes and bases for Processing Personal Data.
Beauvastgoed Processes your Personal Data based on legal bases under the AVG, including:
i. consent from you;
ii. performance of an agreement with you;
iii. fulfillment of a legal obligation; and
iv. the legitimate interest of Beauvastgoed or a third party.
Beauvastgoed Processes certain Personal Data in pursuit of our legitimate interests. Beauvastgoed's legitimate interests include: (direct) marketing, advertising, research of own services, IT management and security, sharing with Beauvastgoed affiliates for e.g. administrative purposes.
Beauvastgoed Processes Personal Data for the following purposes, based on the bases specified therein:

7. Data Security
The security of your personal data is a priority for us. Your data stored with us is therefore protected by us with technical and organizational measures.
Technical security measures for the protection of your data are regularly checked and, if necessary, adapted to the latest technology.
Our employees are required to maintain the confidentiality of your information.
These rules also apply to third-party service providers who process and use data on our behalf and according to our instructions.
8. Retention Periods Personal Data.
The required retention period of Personal Data is determined by Beauvastgoed on the basis of laws and regulations and possible claim risks where the basic principle is that Beauvastgoed does not retain Personal Data longer than necessary.
Beauvastgoed will not retain your information longer than necessary to fulfill the purposes stated in this privacy statement.
a. The retention period of our records is 7 years, in accordance with the legal obligation. This includes the agreements concluded with you, and therefore also the personal data as included in article 19 of the General Provisions, and the period starts after the agreement has been terminated.
b. When you send us an e-mail or ask a question via a contact form, the data you send us will be kept as long as is necessary according to the nature of the form or the content of your e-mail for it to be fully answered and dealt with.
c. Data for marketing activities will be kept for a maximum of 1 year, after contact has been made in the context of offering products or services.
9. Provision of Personal Information to Third Parties and Beauvastgoed Affiliates.
Beauvastgoed will not provide your Personal Data to third parties unless:
a. Personal Data is provided to a Processor (third party service providers) engaged by Beauvastgoed for the purposes listed in this Privacy Statement. These service providers perform certain services on behalf of Beauvastgoed, such as management services, IT services, legal assistance or payment services. Beauvastgoed enters into a (Processor) Agreement with these service providers to ensure the same level of security and confidentiality of your information. Beauvastgoed remains responsible for this Processing; or
b. Beauvastgoed is required by law to disclose Personal Data to competent authorities.
10. Cookies, Social media and third party internet sites
Beauvastgoed makes use of so-called 'cookies'. A cookie is a small (text) file that is stored on your computer by your browser when you visit our Website. More information can be found in our Cookie Statement.
Beauvastgoed has accounts on external platforms, such as Facebook and LinkedIn. It is important to note that Beauvastgoed has no control over how these platforms handle Personal Data. Therefore, the advice is not to share any privacy-sensitive data through these platforms.
Beauvastgoed may include links to Internet sites of third parties. These third parties or others on these Internet sites may collect information about you. Beauvastgoed is not responsible for the content of these Internet sites and the actions of these third parties and others. Beauvastgoed encourages you to familiarize yourself with their policies regarding the Processing of Personal Information.
11. Automated decision-making
Automatic decisions are decisions about you made by computers, and not (anymore) by humans.
Beauvastgoed does not use fully automated decision-making including profiling.
12. Your Rights
By contacting Beauvastgoed, you can exercise all the rights to which you are entitled under applicable privacy laws, including (a) accessing your data, (b) rectifying your data, (c) erasing your data, (d) restricting the Processing of your data, (e) the right to data portability, and (f) the right to object to any Processing.
a. Right of Inspection
You may ask Beauvastgoed whether they process your Personal Data. If they are, you may inspect this information in the form of a copy.
b. Right to rectification
You have the right to rectify your Personal Data if it is inaccurate or incomplete. Upon request, Beauvastgoed will correct inaccurate Personal Data and complete incomplete Personal Data.
c. Right to data erasure
You have the right to have your Personal Data erased. This means that Beauvastgoed will then delete your data. Deletion of your Personal Data only takes place in certain cases, which are prescribed by law and listed in Article 17 of the AVG, for example when your Personal Data is no longer necessary for the purposes for which it was originally Processed or when it has been Processed unlawfully. Due to the way Beauvastgoed has set up certain services, it may take some time for backups to be erased.
d. Right to restrict Processing
You have the right to have the Processing of your Personal Data restricted. This means that Beauvastgoed suspends the Processing of your Personal Data for a certain period of time. Circumstances that may give rise to this include situations in which the accuracy of your Personal Data is disputed, but Beauvastgoed needs some time to verify its accuracy or inaccuracy. This right does not mean that Beauvastgoed may not continue to store your Personal Information. Beauvastgoed will let you know when the restriction is lifted.
e. Right to data portability
Your right to data portability means that you may request Beauvastgoed to obtain your Personal Data, if technically possible, in a structured, common and machine-readable form and transfer it to another processing controller. Upon request and if technically possible, your Personal Data will then be transferred by Beauvastgoed directly to the other processing controller.
f. Right of Objection
You have the right to object to the Processing of your Personal Data. This means that you can ask Beauvastgoed to stop Processing your Personal Data. This only applies if 'legitimate interests' are the legal basis for Processing (see Article 6 'Purposes and bases for Processing Personal Data'). You can object to direct marketing at any time, free of charge, if your Personal Data is Processed for this purpose. If you exercise this right, Beauvastgoed will no longer Process your Personal Data for these purposes.
You may withdraw your consent at any time by following the specific instructions related to the Processing to which you have consented.

14. Changes to this Privacy Statement.
The Privacy Statement may be changed from time to time. We will not provide notice that this statement has been changed. We therefore recommend that you consult this statement regularly.
